RIDESHARE ACCIDENTS

Common Causes of Rideshare Accidents in Utah

Different factors can be involved in Utah rideshare accidents. Some accidents happen purely because of negligence of the driver, while others can be due to a faulty vehicle or inappropriate conditions. Here are the most common causes of rideshare accidents:

Distracted driving while using a rideshare app

Overspeeding

Unsafe lane changes

Failure to yield

Running a red signal

Unsafe pickup or drop-off maneuvers

Fatigued or impaired driving

The cause of the crash can help establish whether a driver, rideshare company, or another party may be legally responsible.

RIDESHARE INJURIES

Injuries in Rideshare Accident Cases

When you book Uber or Lyft, you trust the driver will act responsibly and take you to your destination safely. However, that’s not true in every case, and when a rideshare accident happens, you may suffer from minor to lifelong injuries. Common injuries include:

  • Whiplash and neck injuries
  • Broken bones (wrist, arm, rib, pelvis, and hip fractures)
  • Head injuries (concussions, TBIs)
  • Back and spinal cord injuries
  • Shoulder injuries
  • Knee and leg injuries
  • Internal injuries and organ damage
  • Seat belt injuries, including bruising and chest trauma
  • Cuts, scrapes, and bruises
  • Burns from vehicle fires or airbag deployment
  • Emotional trauma, including anxiety and sleep problems after the crash
PROTECTING YOUR HEALTH & CLAIM

What to Do After a Rideshare Accident in Utah

After you get injured in an Uber or Lyft accident, your every act can affect your claim. What you do early can affect your personal injury claim. Here is what to do after a rideshare accident:

01

Report the Incident

Immediately after the rideshare accident, call 911 for an emergency. Report the incident to law enforcement and through the Uber or Lyft app. A police report gives an independent account of what happened and serves as key evidence in your case.

02

Get Medical Care

See a medical professional right away after the accident, even if you feel fine. Some injuries, like whiplash, show up days later. Keep every record and bill to protect your claim.

03

Preserve Evidence

When safe, take clear pictures of vehicle damage, skid marks, the police report number, road conditions, and any visible injuries. Note eyewitness information, the exact location and time, and ask nearby businesses or property owners for relevant security camera footage as soon as you can.

04

Document Medical Records

Save all medical reports, bills, lost wages, travel expenses, and other accident-related expenses. These records may help explain what happened and document your losses.

05

Be Careful With Recorded Statements

Be careful when relevant auto insurers and rideshare insurers ask for a recorded statement. Don’t guess about what happened or play down your injuries. One statement made too early can hurt your whole claim.

DETERMINING RESPONSIBILITY

Who Can Be Held Liable in a Rideshare Accident Claim

Multiple parties may be found liable in a rideshare accident claim depending upon the circumstances. To prove negligence, you generally need to show duty of care, breach of duty, causation, and damages. Potentially liable parties include:

  • The rideshare driver
  • A third-party driver
  • Transportation Network Companies (TNCs) such as Uber or Lyft
  • Vehicle or parts manufacturer
  • Government entities in certain cases

Rideshare companies like Uber or Lyft generally classify their drivers as “independent contractors,” not employees. When a driver’s negligence causes an accident, this classification does not automatically resolve whether a company may be liable under Utah law. Still, a company can be held liable for its own negligence supported by facts.

UBER & LYFT INSURANCE

How Rideshare Insurance Coverage Works in Utah

Insurance coverage after an Uber or Lyft accident is not always simple. Who pays for your injuries depends on what the driver was doing when the crash happened. Under Utah law (§ 13-51-108), rideshare drivers and companies must carry different levels of insurance at different stages of a trip.

  • The driver’s app is off: The driver’s personal auto insurance usually applies. But coverage depends on the policy and the facts of the accident.
  • The driver is waiting for a ride request: The driver or rideshare company must carry primary liability coverage of at least $50,000 per injured person, $100,000 per accident, and $30,000 for property damage. Required PIP and applicable uninsured and underinsured motorist coverage must also apply as Utah law requires.
  • The driver has accepted a ride or has a passenger in the car: Utah law requires at least $1 million in primary liability coverage per accident. PIP and uninsured or underinsured motorist coverage may also apply as required by Utah law.

Keep in mind that many personal auto policies exclude losses that come from rideshare services. This is why insurers often argue over who should pay. Utah law helps injured people here. The required rideshare coverage generally cannot depend on the driver’s personal insurer denying the claim first.

COMPENSATION IN UTAH

Compensation Available in a Rideshare Accident Claim

Every rideshare accident case is different. The compensation available in an Uber or Lyft accident claim depends on the driver’s status, the policy terms, and how the accident happened. An injured Utah victim may recover compensation across three categories:

01

Economic Damages

Economic damages may include:

  • Emergency medical expenses
  • Ongoing and future medical treatment
  • Rehabilitation and cognitive therapy costs
  • Lost wages and reduced future earning capacity
  • In-home care and caregiver costs in severe cases
  • Property or vehicle damage, when applicable
02

Non-Economic Damages

Non-economic damages may include:

  • Pain and suffering
  • Emotional distress
  • Loss of enjoyment of life
  • Loss of consortium, when legally available
03

Punitive Damages

In limited cases, a court may award punitive damages for misconduct that meets Utah’s legal requirements. These damages punish and deter qualifying wrongful conduct. They are separate from compensation for medical expenses, lost income, pain, and other losses. Their availability depends on the facts and applicable law.

FAQs

Utah’s statute of limitations generally allows you four years to file a personal injury or rideshare accident lawsuit; however, exceptions may apply. Wrongful death cases have a two-year deadline, while one year if a government entity is involved.
After an Uber accident, call 911 if anyone needs emergency help and report it to police. Also, report the accident through the Uber app under Help or visit the Uber Help Center. If you were hit by an Uber vehicle, use Uber’s Third Party Incident Notice.
Possibly. Utah’s modified comparative negligence law may allow you compensation if your share of the fault is less than 50%. However, your compensation is reduced by your percentage of fault. If your fault meets or exceeds the statutory threshold (i.e., 50% or more), you generally cannot recover.
