Rear-end car accidents occur regularly in Utah, but you seldom imagine that you would be involved in one yourself. When it happens, you may not know how to react or what to say; this is understandable. People often call our office with questions like: “Someone rear-ended me, what do I do?” Below are some steps you can take to make sure you handle your accident correctly and not put yourself at fault for the accident.

Stop

Utah Statutes Section Section 41-6a-401.7 requires all drivers involved in accidents that have led to either vehicle damage, injury, or death, to stop at the accident scene. Mostly, a rear-end collision only cause property damage. However, if it results in any injuries, the drivers involved have an obligation to obtain medical assistance. If the accident has only caused property damage, the vehicle drivers should pull their cars on to the side of the road to avoid obstructing traffic flow.

Report

Utah Statutes Section 41-6a-401.4 requires any drivers involved in a vehicle accident that results in damages exceeding $2,500 to notify the authorities about the accident.

Exchange

According to Utah Statute Section 41-6a-401.3a, drivers involved in an accident that results in property damage have to give their name and address to all parties involved in the accident. You also need to provide your driver’s license, registration, and insurance, if available.

All the information provided is used to help facilitate the process for drivers, depending on who’s at fault, to seek compensation for property damage and injuries sustained therein. Due to this, every driver should provide and request all necessary information about the other driver(s) involved before leaving the accident site.

Gather

Generally, people think that the driver who rear-ends the car in front is automatically deemed at fault for the accident; however, this is not always the case. When collecting compensation for damages and injuries suffered, the insurance company only places value on what each party can prove.

Because of this, any driver involved in a rear-end vehicle collision should gather as much evidence of how the accident took place. Among things you could use to gather evidence are:

Taking Pictures of the Vehicle(s)

Obtaining Video Recordings if Possible (Traffic Cameras)

Talk to Witnesses and Receive Testimonies

According to the National Highway Traffic Safety Administration, nearly 1/3 of all traffic accidents are rear-ended collisions. This is when a car, truck, or motorcycle crashes into the back of another vehicle. Many of the most common causes will look familiar to those who have studied traffic accidents before. These include:

Speeding

Distracted driving (texting or eating while driving)

High traffic times

Road Rage

Mechanical failure

Fatigued driving

Operating a vehicle under the influence of drugs or alcohol

If you have been a driver or passenger on Utah’s road, you can see these infractions and dangers on almost a daily basis. Many times, people will follow too closely to the car in front of them. This common situation means that the car cannot properly stop in time should the vehicle they follow needs to make a quick maneuver. In most cases, the person that was following too closely will be found at-fault. Utah’s traffic laws do not allow for many situations where a driver will rear-end someone and not be found to be the person responsible for the traffic accident. It is crucial for individuals who have been hit by a car behind them to speak with an injury lawyer to learn more about their case. It is not right or fair for them to bear the accident’s burden because it was the fault of another.

What injuries can a rear-end collision cause?

Rear-end collisions can often lead to serious damage to personal health. One of the many reasons this is true is because the passengers in the vehicle that has been struct did not see the car coming since it was behind them. This does not allow them to prepare for the accident and brace themselves for impact. One of the most common injuries includes whiplash, where the head is violently shaken back and forth. Remember that significant damage can happen from both high-impact and low-impact collisions. You should seek medical attention after a car accident, even if you initially do not think you have been injured. As a victim of rear-end collisions, there is not much that can be done to avoid these types of accidents. Most vehicles are in a stopped position when they are struck. This is why it is up to everyone to stay alert when their car is in operation.
